1. Acceptance of Terms
By making a booking with Allocentric Tours & Safaris or by using our website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with a booking. These terms form a binding contract between you (the client) and Allocentric Tours & Safaris (the operator).
2. Bookings and Confirmation
A booking is confirmed only upon receipt of the required deposit and written confirmation from our team. Quoted prices are valid for fourteen days from the date of quotation unless otherwise stated. Prices are subject to change without notice until a deposit has been received and the booking confirmed in writing.
3. Payment Terms
A non-refundable deposit of 30 percent of the total booking value is required to confirm any safari. The balance must be paid in full no later than 30 days before the safari start date. For bookings made within 30 days of departure, full payment is required at the time of booking. Payments can be made via bank transfer, M-Pesa, or other methods agreed in writing.
4. Cancellation Policy
If you cancel your booking, the following charges apply:
- More than 60 days before departure: loss of deposit only.
- 30 to 60 days before departure: 50 percent of the total booking value.
- 15 to 29 days before departure: 75 percent of the total booking value.
- Less than 15 days before departure: 100 percent of the total booking value.
All cancellations must be made in writing. We strongly recommend you take out comprehensive travel insurance to cover cancellation, curtailment, and other unforeseen events.
5. Changes by Us
We reserve the right to make changes to your itinerary in case of unforeseen circumstances such as weather, road conditions, wildlife movement, political events, security concerns, or supplier issues. Where significant changes are necessary, we will offer you a reasonable alternative or a refund of any payments made for affected services.
6. Changes by You
Requests to change a confirmed booking must be made in writing. We will do our best to accommodate changes but cannot guarantee availability. Any difference in cost arising from a change will be charged to you. Changes made within 30 days of departure may attract additional administration fees.
7. Travel Documents and Insurance
It is your responsibility to ensure that you have a valid passport, all required visas, vaccinations, and any other travel documents required for your safari. We strongly recommend that all travelers carry comprehensive travel and medical insurance covering trip cancellation, medical emergencies, evacuation, and personal belongings. Allocentric Tours & Safaris is not responsible for losses arising from inadequate travel documents or insurance.
8. Health and Safety
You confirm that you and all members of your travel party are physically and mentally fit to undertake the safari. You must disclose any pre-existing medical conditions, allergies, or special requirements at the time of booking. Safari activities carry inherent risks including wildlife encounters, rough terrain, and remote locations. You participate at your own risk and agree to follow all safety instructions provided by guides and lodges.
9. Liability and Limitation
Allocentric Tours & Safaris acts as an intermediary between you and various third-party suppliers including lodges, camps, transport providers, and activity operators. We exercise reasonable care in selecting our suppliers but are not liable for the acts, omissions, or default of these third parties. Our liability for any loss, damage, injury, or expense suffered by you in connection with the safari is limited to the total amount paid by you for the booking.
We are not liable for delays, cancellations, or losses caused by events beyond our reasonable control including weather, natural disasters, political unrest, strikes, government action, illness, or wildlife behavior.
10. Wildlife and Park Conduct
You agree to follow the rules and codes of conduct of all national parks, reserves, and conservancies visited. You will not approach or feed wildlife, will remain in the vehicle except where expressly permitted, and will follow all instructions from guides. You acknowledge that wildlife sightings cannot be guaranteed.
11. Photography and Marketing
During your safari, our staff may take photographs or videos. By participating in the safari, you consent to the use of such images and videos for our marketing materials, website, and social media. If you wish to opt out, please notify us in writing before your safari begins.
12. Complaints
If you have a complaint during your safari, you must raise it immediately with your guide or the relevant supplier so we have an opportunity to resolve it. Any complaint not resolved during the safari must be submitted to us in writing within 14 days of return. We will respond within 21 days.
13. Governing Law
These Terms and Conditions are governed by the laws of Kenya. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
